LAURIE POHUTSKY CHAIR COMMITTEE MEETING MINUTES Thursday, October 5, 2023 10:30 AM Room 327, House Office Building The House Committee on Natural Resources, Environment, Tourism and Outdoor Recreation was called to order by Chair Pohutsky. The Chair requested attendance be called: Present: Reps. Pohutsky, Hill, Shannon, Arbit, McFall, Paiz, Martin, Prestin, Schriver. Absent: None. Excused: None. Representative Shannon moved to adopt the meeting minutes from September 28, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5028 before the committee: HB 5028 (Rep. Puri) A bill to invalidate certain provisions in homeowners' association agreements that prohibit the replacement, maintenance, installation, or operation of certain energy-saving improvements or modifications or the installation of solar energy systems; to provide for the adoption of certain policy statements; to prescribe penalties and remedies; and to provide for the powers and duties of certain state and local governmental officers and entities. Representative Puri testified in support of HB 5028. Questions and discussion followed. Grace Michienzi, representing The Michigan Energy Innovation Business Council, testified in support of HB 5028. The Chair laid HB 4325 before the committee: HB 4325 (Rep. Scott) A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 8905a (MCL 324.8905a), as amended by 2014 PA 549. Chair Pohutsky offered the following amendments to HB 4325: 1. Amend page 4, line 1, after "group" by inserting a comma and "or village or township,". 2. Amend page 4, line 6, after "city" by inserting a comma and "village,". 3. Amend page 4, line 14 after "group" by inserting a comma and "or village or township,". Chair Pohutsky moved to adopt the amendments to HB 4325. The motion prevailed 9-0-0: FAVORABLE ROLL CALL Yeas: Reps. Pohutsky, Hill, Shannon, Arbit, McFall, Paiz, Martin, Prestin, Schriver. Nays: None. Pass: None. The following people submitted a card in support of HB 4325, but did not wish to speak: John LaMacchia, representing the Michigan Municipal League. Tim Minotas, representing the Sierra Club of Michigan. Justin Tomei, representing the Michigan United Conservation Clubs. Representative McFall moved to report out HB 4325 with recommendation, as amended. The motion prevailed 7-0-2: FAVORABLE ROLL CALL Yeas: Reps. Pohutsky, Hill, Shannon, Arbit, McFall, Paiz, Schriver. Nays: None. Pass: Reps. Martin, Prestin. There being no further business before the committee, Chair Pohutsky adjourned the meeting at 11:04 AM.
