HOUSE OF REPRESENTATIVES COMMITTEE ON LABOR REP. JIM HAADSMA CHAIR COMMITTEE MEETING MINUTES Thursday, October 26, 2023 9:00 AM Room 326, House Office Building The House Committee on Labor was called to order by Chair Haadsma. The Chair requested attendance be called: Present: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela, Wozniak, Mueller, Kunse. Absent: None. Excused: None. Representative Koleszar moved to adopt the meeting minutes from October 19, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 169 before the committee: SB 169 (Sen. Cherry) A bill to amend 1947 PA 336, entitled "An act to prohibit strikes by certain public employees; to provide review from disciplinary action with respect thereto; to provide for the mediation of grievances and the holding of elections; to declare and protect the rights and privileges of public employees; to require certain provisions in collective bargaining agreements; to prescribe means of enforcement and penalties for the violation of the provisions of this act; and to make appropriations," (MCL 423.201 to 423.217) by adding section 11a. Representative Kunse introduced and explained his package of amendments to SB 169. Representative Kunse offered the following amendment to SB 169: 1. Amend page 3, following line 9, by inserting: "(4) A representative that receives a public employee's employment and contact information under subsection (1) shall not use the information to do either of the following: (a) Persuade the public employee to become a member of the representative. (b) Request dues or service fees from the public employee if the public employee is not a member of the representative.". Representative Kunse moved to adopt the amendment to SB 169. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Wozniak, Mueller, Kunse. Nays: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Pass: None. Representative Kunse offered the following amendments to SB 169: 1. Amend page 1, line 4, after "11" by inserting "if the public employee elects to provide the public employee's information under subsection (4)". 2. Amend page 2, line 3, after "representative" by inserting "who elect to provide the information under subsection (4)". 3. Amend page 3, following line 9, by inserting: "(4) A public employee may, by submitting a written request to the public employee's public employer, elect to provide the public employee's employment and contact information to a representative as provided for under subsection (1).". Representative Kunse moved to adopt the amendments to SB 169. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Wozniak, Mueller, Kunse. Nays: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Pass: None. Representative Kunse offered the following amendment to SB 169: 1. Amend page 2, line 11, by striking out the balance of the subsection. Representative Kunse moved to adopt the amendment to SB 169. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Wozniak, Mueller, Kunse. Nays: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Pass: None. Representative Kunse offered the following amendment to SB 169: 1. Amend page 3, following line 9, by inserting: "(4) Every 90 days, a bargaining representative shall provide to each public employee in the bargaining unit that the bargaining representative represents the following statement in writing: "Under the United States Supreme Court decision Janus v AFSCME, Council 31, US ; 138 S Ct 2448 (2018), it is a violation of a public employee's First Amendment free speech rights for a public-sector bargaining representative to extract agency fees or union security fees from the public employee unless the public employee consents.".". Representative Kunse moved to adopt the amendment to SB 169. The motion did not prevail 3-7-0: UNFAVORABLE ROLL CALL Yeas: Reps. Wozniak, Mueller, Kunse. Nays: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Pass: None. Representative Mentzer moved to report out SB 169 with recommendation. The motion prevailed 7-3-0: FAVORABLE ROLL CALL Yeas: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Nays: Reps. Wozniak, Mueller, Kunse. Pass: None. The Chair laid HB 4729 before the committee: HB 4729 (Rep. Snyder) A bill to amend 1969 PA 317, entitled "Worker's disability compensation act of 1969," by amending section 405 (MCL 418.405), as amended by 2021 PA 129. Representative Snyder, and David Glotzbach, representing the Michigan Association of Fire Chiefs, testified in support of HB 4729. Dave Hodgkins, representing the Michigan Municipal League, testified in opposition to HB 4729. Questions and discussion followed. The following people submitted a card in support of HB 4729, but did not wish to speak: Leo Allaire, representing the Delhi Township Fire Department. Dawn Kettinger, representing the Michigan Nurses Association. The following people submitted a card in opposition to HB 4729, but did not wish to speak: Mike Batterbee, representing the Michigan Townships Association.
