KARA HOPE CHAIR COMMITTEE MEETING MINUTES Tuesday, February 6, 2024 9:00 AM Room 519, House Office Building The House Committee on Criminal Justice was called to order by Chair Hope. The Chair requested attendance be called: Present: Reps. Hope, Andrews, Tyrone Carter, Breen, Young, Arbit, Dievendorf, Tsernoglou, Filler, Mueller, Harris, BeGole. Absent: Rep. Bezotte. Excused: Rep. Bezotte. Representative Andrews moved to adopt the meeting minutes from October 31, 2023. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5182 and HB 5183 before the committee: HB 5182 (Rep. Mentzer) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 116 (MCL 750.116). HB 5183 (Rep. Farhat) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 16f of chapter XVII (MCL 777.16f), as amended by 2000 PA 498. Representative Farhat and Representative Mentzer testified in support of HB 5182 and HB 5183. Questions and discussion followed. Joe Morgan, representing the Troy Police Department, testified in support of HB 5182 and HB 5183. Questions and discussion followed. Issa Shahin, representing the Dearborn Police Department, testified in support of HB 5182 and HB 5183. Questions and discussion followed. Mark Hackel, representing Macomb County, testified in support of HB 5182 and HB 5183. Gabrielle Dresner, representing the ACLU of Michigan, testified in opposition to HB 5182 and HB 5183. Brandon Lanyon, representing the Prosecuting Attorneys Association of Michigan. The Chair laid HB 5393 before the committee: HB 5393 (Rep. Hope) A bill to amend 1939 PA 288, entitled "Probate code of 1939," by amending section 2f of chapter XIIA (MCL 712A.2f), as amended by 2023 PA 301. At 9:42 AM, the Chair laid the committee at ease. At 9:43 AM, Majority Vice Chair Andrews called the committee back to order. Chair Hope and Trevor VanDyke representing the State Court Administrative Office testified in support of HB 5393. At 9:45 AM, Majority Vice Chair Andrews laid the committee at ease. At 9:46 AM, the Chair called the committee back to order. Thom Lattig, representing the Michigan Association of Family Court Administrators, testified in support of HB 5393. The following people submitted a card in support of HB 5393, but did not wish to speak: Jennifer Peacock, representing the Michigan Center for Youth Justice. Chardae Burton, representing the Michigan Department of Health and Human Services. Representative Breen moved to report out HB 5393 with recommendation. The motion prevailed 8-4-0: FAVORABLE ROLL CALL Yeas: Reps. Hope, Andrews, Tyrone Carter, Breen, Young, Arbit, Dievendorf, Tsernoglou. Nays: Reps. Filler, Mueller, Harris, BeGole. Pass: None. Representative Young moved to excuse Representative Bezotte from the meeting. There being no objection the motion prevailed by unanimous consent.
