HOUSE OF REPRESENTATIVES COMMITTEE ON LABOR REP. JIM HAADSMA CHAIR COMMITTEE MEETING MINUTES Thursday, February 29, 2024 9:00 AM Room 326, House Office Building The House Committee on Labor was called to order by Chair Haadsma. The Chair requested attendance be called: Present: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela, Wozniak, Mueller, Kunse. Absent: None. Excused: None. Representative Wegela moved to adopt the meeting minutes from November 2, 2023. There being no objection, the motion prevailed by unanimous consent. Chair Haadsma offered the following proposed Committee rules: 1. For any item of legislation considered by the committee, at least 1 meeting will be called at which the public may address the committee regarding that item of legislation. Oral testimony may be limited at the discretion of the committee chair. The Committee may accept written testimony in lieu of oral testimony. 2. All testimony shall be on the subject matter pertaining to the committee agenda. Representative Mentzer moved to adopt the proposed Committee rules. The motion prevailed 10-0-0: FAVORABLE ROLL CALL Yeas: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela, Wozniak, Mueller, Kunse. Nays: None. Pass: None. The Chair laid before the committee the presentation on the new federal rule on independent contractors and its impact on workers and employers. Sean Egan and Randall Harrison, representing the Michigan Department on Labor and Economic Opportunity, testified to the presentation on the new federal rule on independent contractors and its impact on workers and employers. Questions and discussion followed. Sally Dworak-Fisher, a senior staff attorney from the National Employment Law Project, testified to the presentation on the new federal rule on independent contractors and its impact on workers and employers. Questions and discussion followed. The Chair laid HB 5164 and HB 5165 before the committee: HB 5164 (Rep. O'Neal) A bill to create the call center jobs retention act; to provide for the powers and duties of certain state governmental officers and entities; to impose certain duties on certain employers; and to prescribe civil sanctions. HB 5165 (Rep. O'Neal) A bill to amend 1984 PA 270, entitled "Michigan strategic fund act," (MCL 125.2001 to 125.2094) by adding section 15. The following people submitted a card in support of HB 5164 and HB 5165, but did not wish to speak: Ryan Sebolt, representing the Michigan American Federation of Labor and Congress of Industrial Organizations. Stephanie Johnson, representing the Utility Workers Union of America. The following person submitted a card in opposition to HB 5164 and HB 5165, but did not wish to speak: David Worthams, representing the Michigan Manufacturers Association. Representative Koleszar moved to report out HB 5164 with recommendation. The motion prevailed 7-3-0: FAVORABLE ROLL CALL Yeas: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Nays: Reps. Wozniak, Mueller, Kunse. Pass: None. Representative Churches moved to report out HB 5165 with recommendation. The motion prevailed 7-3-0: FAVORABLE ROLL CALL Yeas: Reps. Haadsma, Mentzer, Koleszar, O'Neal, Andrews, Churches, Wegela. Nays: Reps. Wozniak, Mueller, Kunse. Pass: None.
