- HOUSE OF REPRESENTATIVES COMMITTEE ON CRIMINAL JUSTICE REP. KARA HOPE CHAIR COMMITTEE MEETING MINUTES Tuesday, March 5, 2024 9:00 AM Room 519, House Office Building The House Committee on Criminal Justice was called to order by Chair Hope. The Chair requested attendance be called: Present: Reps. Hope, Andrews, Tyrone Carter, Breen, Young, Arbit, Dievendorf, Tsernoglou, Filler, Mueller, Bezotte, Harris, BeGole. Absent: None. Excused: None. Representative Andrews moved to adopt the meeting minutes from February 27, 2024. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5392 before the committee: HB 5392 (Rep. Lightner) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 1k of chapter IX (MCL 769.1k), as amended by 2022 PA 199. Representative Tyrone Carter moved to report out HB 5392 with the recommendation that the bill be referred to the Committee on Judiciary. The motion prevailed 11-0-0: FAVORABLE ROLL CALL Yeas: Reps. Hope, Andrews, Tyrone Carter, Young, Dievendorf, Tsernoglou, Filler, Mueller, Bezotte, Harris, BeGole. Nays: None. Pass: None. The Chair laid HB 5271 and HB 5431 before the committee: HB 5271 (Rep. Hope) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 16 of chapter X (MCL 770.16), as amended by 2015 PA 229. HB 5431 (Rep. Andrews) A bill to amend 2016 PA 343, entitled "Wrongful imprisonment compensation act," by amending sections 2, 4, 5, and 7 (MCL 691.1752, 691.1754, 691.1755, and 691.1757), section 7 as amended by 2020 PA 43. At 9:07 AM, the Chair laid the committee at ease. At 9:08 AM, Majority Vice Chair Andrews called the committee back to order. Chair Hope and Marla Mitchell-Cichon, representing the Cooley Law Innocence Project, testified together in support of HB 5271 and HB 5431. Questions and discussion followed. At 9:33 AM, Majority Vice Chair Andrews laid the committee at ease. At 9:34 AM, the Chair called the committee back to order. Amanda Wallwin, representing The Innocence Project, testified in support of HB 5271 and HB 5431. Robyn Frankel, Ashley Steffen, and Aaron Van Langevelde, all representing the Michigan Department of Attorney General, testified together in support of HB 5271 and HB 5431. Jessica Zimbelman, representing CDAM / SADO, testified in support of HB 5271 and HB 5431. Questions and discussion followed. Ken Nixon, representing Safe and Just Michigan, testified in support of HB 5271 and HB 5431. Kevin Harrington, Co-founder and Board Member for the Organization of Exonerees and CEO of Blessed and Highly Favored Always, testified in support of HB 5271 and HB 5431. Representative Andrews and Marla Mitchell-Cichon, representing the Cooley Law Innocence Project, testified together in support of HB 5431. Eric Anderson, Secretary for the Organization of Exonerees, testified in support of HB 5271 and HB 5431. Laurie Moore, representing After Innocence, testified in support of HB 5271 and HB 5431.
