HOUSE OF REPRESENTATIVES COMMITTEE ON JUDICIARY REP. KELLY A BREEN CHAIR COMMITTEE MEETING MINUTES Wednesday, March 6, 2024 10:30 AM Room 521, House Office Building The House Committee on Judiciary was called to order by Chair Breen. The Chair requested attendance be called: Present: Reps. Breen, Edwards, Tyrone Carter, Hope, Arbit, Dievendorf, Hoskins, Tsernoglou, Fink, Wendzel, Wozniak, Johnsen. Absent: Rep. Outman. Excused: Rep. Outman. Representative Edwards moved to adopt the meeting minutes from February 21, 2024. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5429 before the committee: HB 5429 (Rep. Morse) A bill to create the court-appointed special advocate program; and to prescribe the duties and responsibilities of the court-appointed special advocate program and volunteers. Representative Tyrone Carter moved to report out HB 5429 with recommendation. The motion prevailed 7-0-4: FAVORABLE ROLL CALL Yeas: Reps. Breen, Edwards, Tyrone Carter, Hope, Dievendorf, Hoskins, Tsernoglou. Nays: None. Pass: Reps. Fink, Wendzel, Wozniak, Johnsen. The Chair laid HB 5534 and HB 5392 before the committee: HB 5534 (Rep. Breen) A bill to require the supreme court to analyze certain trial court costs and revenue sources; and to develop legislative proposals to change trial court funding. HB 5392 (Rep. Lightner) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 1k of chapter IX (MCL 769.1k), as amended by 2022 PA 199. At 10:35 AM, the Chair laid the committee at ease. At 10:36 AM, Rep. Tyrone Carter called the committee back to order. Chair Breen testified in support of HB 5534. At 10:38 AM, Rep. Tyrone Carter laid the committee at ease. At 10:39 AM, the Chair called the committee back to order. Rep. Lightner testified in support of HB 5392. Questions and discussion followed. Tom Boyd, State Court Administrator, and Trevor VanDyke, Deputy General Counsel, both representing the State Court Administrative Office, testified in support of HB 5534 and HB 5392. Hersanna Richards, representing the Michigan Municipal League, testified in support of HB 5534 and HB 5392. Questions and discussion followed. The following person submitted a card in support of HB 5534 and HB 5392, but did not wish to speak: Noah Smith, representing the Criminal Defense Attorneys of Michigan. Representative Hope moved to excuse Representative Outman from the meeting. There being no objection the motion prevailed by unanimous consent.
