- HOUSE OF REPRESENTATIVES COMMITTEE ON LOCAL GOVERNMENT AND MUNICIPAL FINANCE REP. JOHN FITZGERALD CHAIR COMMITTEE MEETING MINUTES Wednesday, March 6, 2024 12:00 PM Room 519, House Office Building The House Committee on Local Government and Municipal Finance was called to order by Chair Fitzgerald. The Chair requested attendance be called: Present: Reps. Fitzgerald, Byrnes, Shannon, Breen, Rogers, Hill, Hoskins, Paiz, Zorn, Paquette, Bezotte, BeGole, Prestin. Absent: None. Excused: None. Representative Paiz moved to adopt the meeting minutes from February 21, 2024. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5203 before the committee: HB 5203 (Rep. Breen) A bill to amend 1851 PA 156, entitled "An act to define the powers and duties of the county boards of commissioners of the several counties, and to confer upon them certain local, administrative and legislative powers; and to prescribe penalties for the violation of the provisions of this act," by amending section 12a (MCL 46.12a), as amended by 2017 PA 204. Representative Breen moved to report out HB 5203 with recommendation. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Fitzgerald, Byrnes, Shannon, Breen, Rogers, Hill, Hoskins, Paiz, Zorn, Paquette, Bezotte, BeGole, Prestin. Nays: None. Pass: None. The Chair laid SB 721 before the committee: SB 721 (Sen. Moss) A bill to amend 1945 PA 200, entitled "An act to define a marketable record title to an interest in land; to require the filing of notices of claim of interest in such land in certain cases within a definite period of time and to require the recording thereof; to make invalid and of no force or effect all claims with respect to the land affected thereby where no such notices of claim of interest are filed within the required period; to provide for certain penalties for filing slanderous notices of claim of interest, and to provide certain exceptions to the applicability and operation thereof," by amending sections 1 and 3 (MCL 565.101 and 565.103), section 1 as amended by 2018 PA 572 and section 3 as amended by 2020 PA 294. Elizabeth Crenshaw, representing Senator Moss, testified in support of SB 721. David Pierson, representing the Real Property Law Section, State Bar of Michigan, testified in support of SB 721. Questions and discussion followed. The following person submitted a card in support of SB 721, but did not wish to speak: Evie Sweeney, representing the International Council of Shopping Centers. Representative Byrnes moved to report out SB 721 with recommendation. The motion prevailed 8-0-5: FAVORABLE ROLL CALL Yeas: Reps. Fitzgerald, Byrnes, Shannon, Breen, Rogers, Hill, Hoskins, Paiz. Nays: None. Pass: Reps. Zorn, Paquette, Bezotte, BeGole, Prestin. The Chair laid HB 5353 before the committee: HB 5353 (Rep. Fitzgerald) A bill to implement section 29 of article IX of the state constitution of 1963; to provide a process for state compliance with its obligation to finance the costs incurred by local units of government to provide, administer, and implement certain activities or services required by this state; to prescribe the powers and duties of certain state agencies and public officers; to prescribe certain powers and duties of the legislative branch; to provide for the administration of this act; and to repeal acts and parts of acts. At 12:15 PM, the Chair laid the committee at ease. At 12:15 PM, Majority Vice Chair Byrnes called the committee back to order. Representative Fitzgerald testified in support of HB 5353.
