- HOUSE OF REPRESENTATIVES COMMITTEE ON INSURANCE AND FINANCIAL SERVICES REP. BRENDA CARTER CHAIR COMMITTEE MEETING MINUTES Thursday, April 25, 2024 9:00 AM Room 521, House Office Building The House Committee on Insurance and Financial Services was called to order by Chair Brenda Carter. The Chair requested attendance be called: Present: Reps. Brenda Carter, McFall, Rogers, Scott, Young, Fitzgerald, Grant, Hoskins, Tsernoglou, Harris, Bezotte, Aragona, Neyer, Smit. Absent: Reps. Breen, Markkanen, Bruck. Excused: Reps. Breen, Markkanen, Bruck. Representative Young joined the committee remotely. Representative Fitzgerald moved to adopt the meeting minutes from April 18, 2024. There being no objection, the motion prevailed by unanimous consent. Chair Brenda Carter offered the following proposed Committee rules: 1. For any item of legislation considered by the committee, at least 1 meeting will be called at which the public may address the committee regarding that item of legislation. Oral testimony may be limited at the discretion of the committee chair. The Committee may accept written testimony in lieu of oral testimony. 2. All testimony shall be on the subject matter pertaining to the committee agenda. Representative Rogers moved to adopt the proposed Committee rules. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Carter, McFall, Rogers, Scott, Fitzgerald, Grant, Hoskins, Tsernoglou, Harris, Bezotte, Aragona, Neyer, Smit. Nays: None. Pass: None. The Chair laid SB 27 before the committee: SB 27 (Sen. Anthony) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," (MCL 500.100 to 500.8302) by adding section 3406hh. The following people submitted a card in support of SB 27, but did not wish to speak: Donna Baker-Miller, representing MCG Health. Amy Stanton, representing the Michigan Education Special Services Association. Representative Tsernoglou moved to report out SB 27 with recommendation. The motion prevailed 12-0-1: FAVORABLE ROLL CALL Yeas: Reps. Brenda Carter, McFall, Rogers, Scott, Fitzgerald, Grant, Hoskins, Tsernoglou, Harris, Bezotte, Aragona, Neyer. Nays: None. Pass: Rep. Smit. The Chair laid HB 5191, HB 5192, HB 5193, HB 5194, HB 5195, HB 5196 and HB 5197 before the committee: HB 5191 (Rep. Brenda Carter) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 15a of chapter XVII (MCL 777.15a), as added by 2002 PA 206. HB 5192 (Rep. Brenda Carter) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 4509 (MCL 500.4509), as added by 1995 PA 276. HB 5193 (Rep. Neeley) A bill to amend 1984 PA 323, entitled "The health care false claim act," by amending section 2 (MCL 752.1002). HB 5194 (Rep. Harris) A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 159g (MCL 750.159g), as amended by 2022 PA 174. HB 5195 (Rep. McFall) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 4511 (MCL 500.4511), as added by 1995 PA 276. HB 5196 (Rep. Aragona) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 150 (MCL 500.150), as amended by 2019 PA 21. HB 5197 (Rep. Fitzgerald) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," (MCL 500.100 to 500.8302) by adding section 4506. At 9:06 AM, the Chair laid the committee at ease. At 9:06 AM, Majority Vice Chair McFall called the committee back to order. Representative Carter, Representative Harris, and Jospeh Sullivan, representing the Michigan Department of Insurance and Financial Services, testified in support of HBs 5191, 5192, 5193, 5194, 5195, 5196, and 5197. Questions and discussion followed. At 9:22 AM, Majority Vice Chair McFall laid the committee at ease. At 9:24 AM, the Chair called the committee back to order. Mitchell Meyers, representing CURE Auto Insurance, testified in support of HBs 5191, 5192, 5193, 5194, 5195, 5196, and 5197. The following people submitted a card in support of HB 5191, HB 5192, HB 5193, HB 5194, HB 5195, HB 5196 and HB 5197, but did not wish to speak: Alex Houseman, representing Big I Michigan. Dyck Van Koevering, representing the Insurance Alliance of Michigan. Craig Sepich, representing the National Insurance Crime Bureau. The following person submitted a card in support of HB 5197, but did not wish to speak: Christine Shearer, representing the Michigan Association of Health Plans. Representative Smit moved to excuse Representatives Breen, Markkanen and Bruck from the meeting. There being no objection, the motion prevailed by unanimous consent. There being no further business before the committee, Representative Grant moved to adjourn, Chair Brenda Carter adjourned the meeting at 9:30 AM.
