KELLY A BREEN CHAIR COMMITTEE MEETING MINUTES Wednesday, May 22, 2024 10:30 AM Room 521, House Office Building The House Committee on Judiciary was called to order by Chair Breen. The Chair requested attendance be called: Present: Reps. Breen, Edwards, Tyrone Carter, Hope, Arbit, Dievendorf, Hoskins, Tsernoglou, Fink, Wendzel, Wozniak, Outman, Johnsen. Absent: None. Excused: None. Representative Edwards moved to adopt the meeting minutes from May 15, 2024. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5404, HB 5405 and HB 5525 before the committee: HB 5404 (Rep. Paiz) A bill to amend 1927 PA 175, entitled "The code of criminal procedure," by amending section 17b of chapter XVII (MCL 777.17b), as added by 2002 PA 28. HB 5405 (Rep. Paiz) A bill to amend 1937 PA 10, entitled "An act to define the use of travel aids by blind persons; to provide protection against accidents to such persons; to require instruction and examination in certain circumstances; and to provide penalties for violation hereof," by amending sections 1a and 3 (MCL 752.51a and 752.53), section 1a as amended by 2002 PA 401 and section 3 as amended by 1986 PA 62. HB 5525 (Rep. Paiz) A bill to amend 1961 PA 236, entitled "Revised judicature act of 1961," (MCL 600.101 to 600.9947) by adding section 2980. Representative Paiz and Senator Singh testified together in support of HB 5404, HB 5405 and HB 5525. Questions and discussion followed. Bee Friedlander, representing Attorneys for Animals, testified in support of HB 5404, HB 5405 and HB 5525. Questions and discussion followed. Robert Parsons, representing the National Federation of the Blind, Michigan Chapter, testified in support of HB 5404 and HB 5405. Karla Hudson, representing herself, testified in support of HB 5404 and HB 5405. The following person submitted a card in support of HB 5525, but did not wish to speak: Mitch Albers, representing the Michigan Association for Justice. The following people submitted a card in opposition to HB 5525, but did not wish to speak: Dr. Janet Donlin, representing the American Veterinary Medical Association. Matt Breslin, representing the Michigan Veterinary Medical Association. The Chair laid SB 351 before the committee: SB 351 (Sen. Irwin) A bill to amend 2014 PA 197, entitled "Breastfeeding antidiscrimination act," by amending the title and section 2 (MCL 37.232). Representative Edwards moved to report out SB 351 with recommendation. The motion prevailed 9-0-4: FAVORABLE ROLL CALL Yeas: Reps. Breen, Tyrone Carter, Hope, Arbit, Dievendorf, Hoskins, Tsernoglou, Outman, Johnsen. Nays: None. Pass: Reps. Edwards, Fink, Wendzel, Wozniak. The Chair laid HB 5328 before the committee: HB 5328 (Rep. Wilson) A bill to amend 1992 PA 234, entitled "The judges retirement act of 1992," by amending section 714 (MCL 38.2664), as amended by 2002 PA 95. The following people submitted a card in support of HB 5328, but did not wish to speak: Trevor VanDyke, representing the State Court Administrative Office. Judge Mike Carpenter, President of the Michigan District Judges Association. The following person submitted a card with no position on HB 5328, but did not wish to speak: Neil DeSouza, representing the Office of Retirement Services - DTMB. Representative Hope moved to report out HB 5328 with recommendation. The motion prevailed 10-1-1: FAVORABLE ROLL CALL Yeas: Reps. Breen, Edwards, Tyrone Carter, Hope, Arbit, Dievendorf, Hoskins, Tsernoglou, Wozniak, Johnsen. Nays: Rep. Outman. Pass: Rep. Wendzel. The Chair laid HB 5110 before the committee: HB 5110 (Rep. Wozniak) An act to allow certain fiduciaries to convert income trusts to unitrusts, convert express unitrusts to income trusts, and change the percentage or method used to calculate unitrust amounts. Representative Wozniak testified in support of HB 5110. Questions and discussion followed. Jim Spica, representing the Probate and Estate Planning Section of the State Bar of Michigan, testified in support of HB 5110. Questions and discussion followed.
