Representative Brann moved to adopt substitute (H-2) to HB 5790. The motion prevailed 27- 0-0: FAVORABLE ROLL CALL Yeas: Reps. Albert, Whiteford, Allor, Brann, Frederick, Hornberger, Marino, VanSingel, Yaroch, Bollin, Glenn, Lightner, Maddock, Slagh, VanWoerkom, Beson, Borton, Tate, Sabo, Tyrone Carter, Hood, Brabec, O'Neal, Rogers, Steckloff, Thanedar, Weiss. Nays: None. Pass: None. Marcus Coffin, representing the House Fiscal Agency, introduced the substitute (H-2) for HB 5790. Representative Brann gave remarks on the bill. Representative Tyrone Carter offered the following amendments to HB 5790 (H-2): 1. Amend page 8, following line 6, by inserting: Use of force and officer misconduct registry 1,000,000 and adjusting the subtotals, totals, and section 201 accordingly. 2. Amend page 61, following line 7, by inserting: "Sec. 830. (1) Funds appropriated in part 1 for use of force and officer misconduct registry must be used to create and maintain a use of force and officer misconduct registry, which must be accessible to all public safety departments in this state. The registry must contain all of the following information: (a) Name of any officer terminated for on-the-job misconduct and a description of the misconduct. (b) Name of any officer involved in an on-the-job use of force incident and any applicable information regarding the incident, including whether the incident resulted in any disciplinary action. (2) The unexpended funds appropriated in part 1 for use of force and officer misconduct registry are designated as a work project appropriation. Unencumbered or unallotted funds shall not lapse at the end of the fiscal year and shall be available for expenditures under this section until the project has been completed. The following is in compliance with section 451a of the management and budget act, 1984 PA 431, MCL 18.1451a (a) The purpose of the project is to create and maintain a use of force and officer misconduct registry. (b) The project will be accomplished by utilizing state employees, contracts with vendors, or local partners. (c) The estimated cost of the project is $1,000,000.00. (d) The tentative completion date is September 30, 2027.".
