ROGER HAUCK CHAIR COMMITTEE MEETING MINUTES Tuesday, November 30, 2021 10:30 AM Room 519, House Office Building The House Committee on Regulatory Reform was called to order by Chair Hauck. The Chair requested attendance be called: Present: Reps. Hauck, Hoitenga, Bellino, Hall, Mueller, Wendzel, Clements, Damoose, Outman, Hertel, Yancey, Witwer, Steenland, Young. Absent: Rep. Garza. Excused: Rep. Garza. Representative Yancey joined the committee remotely. Representative Bellino moved to adopt the meeting minutes from November 9, 2021. There being no objection, the motion prevailed by unanimous consent. The Chair laid SB 405 before the committee: SB 405 (Sen. MacDonald) A bill to amend 1917 PA 273, entitled "An act to regulate and license pawnbrokers that conduct business in this state; to provide for the disposition of allegedly misappropriated property in the possession of pawnbrokers; to provide remedies and prescribe penalties; and to provide for the powers and duties of certain local governmental units and state agencies," by amending the title and sections 8, 9, and 18 (MCL 446.208, 446.209, and 446.218), the title and section 9 as amended by 2018 PA 345 and section 8 as amended by 2002 PA 469. Kim Wadaga, representing Senator MacDonald, testified in support of SB 405. Questions and discussion followed. Mark Aubrey, representing the Michigan Pawnbrokers Association, testified in support of SB 405. The Chair laid HB 5429, HB 5430, HB 5431 and HB 5432 before the committee: HB 5429 (Rep. Beeler) A bill to amend 2009 PA 229, entitled "Guaranteed asset protection waiver act," by amending the title and sections 1, 3, 5, 7, 9, and 11 (MCL 492.21, 492.23, 492.25, 492.27, 492.29, and 492.31), by adding sections 3a, 4, and 9a and parts 5 and 9, and by designating section 1 as part 1, section 3 as part 2, section 3a as part 3, sections 4, 5, 7, 9, and 9a as part 4, and section 11 as part 6; and to repeal acts and parts of acts. HB 5430 (Rep. Witwer) A bill to amend 1966 PA 224, entitled "Retail installment sales act," by amending section 3 (MCL 445.853), as amended by 2009 PA 232. HB 5431 (Rep. Damoose) A bill to amend 1950 (Ex Sess) PA 27, entitled "Motor vehicle sales finance act," by amending section 13 (MCL 492.113), as amended by 2009 PA 231. HB 5432 (Rep. Hertel) A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 127 (MCL 500.127), as added by 2009 PA 230. Representative Beeler testified in support of HB 5429, HB 5430, HB 5431 and HB 5432. Aaron Lunt, representing the Guaranteed Asset Protection Alliance, testified in support of HB 5429, HB 5430, HB 5431 and HB 5432. The Chair laid HR 158 before the committee: HR 158 (Rep. Yaroch) A resolution to urge the Congress of the United States to clarify its position on the legality of marijuana under the Controlled Substances Act of 1970. Representative Mueller moved to report out HR 158 with recommendation. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Hauck, Hoitenga, Bellino, Hall, Mueller, Wendzel, Clements, Damoose, Outman, Hertel, Witwer, Steenland, Young. Nays: None. Pass: None. The Chair laid HB 5449 before the committee: HB 5449 (Rep. Clements) A bill to amend 1987 PA 96, entitled "The mobile home commission act," by amending section 30i (MCL 125.2330i), as amended by 2005 PA 162, and by adding section 30j. Representative Mueller moved to report out HB 5449 with recommendation. The motion prevailed 13-0-0: FAVORABLE ROLL CALL Yeas: Reps. Hauck, Hoitenga, Bellino, Hall, Mueller, Wendzel, Clements, Damoose, Outman, Hertel, Witwer, Steenland, Young. Nays: None. Pass: None. The following people submitted a card in support of HB 5449, but did not wish to speak: John Lindley, representing the Michigan Manufactured Housing Association. Alex Houseman, representing the Michigan Realtors. Representative Hertel moved to excuse Representative Garza from the meeting. There being no objection the motion prevailed by unanimous consent.
