HOUSE OF REPRESENTATIVES COMMITTEE ON GOVERNMENT OPERATIONS REP. JASON M SHEPPARD CHAIR COMMITTEE MEETING MINUTES Wednesday, April 10, 2019 9:00 AM Room 307, House Office Building The House Standing Committee on Government Operations was called to order by the Chair. The Chair requested attendance be called: Present: Reps. Sheppard, Cole, Lilly, Greig, Rabhi. Absent/Excused: None. Representative Cole moved to adopt the meeting minutes from March 19, 2019. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 4440 before the committee: HB 4440 (Rep. Lilly) A bill to amend 2016 PA 281, entitled “Medical marihuana facilities licensing act,” by amending section 402 (MCL 333.27402), as amended by 2018 PA 582. Representative Lilly testified in support of HB 4440. Questions and discussion followed. Joe Neller, representing Green Peak, testified in support of HB 4440. Questions and discussion followed. Ben Jothe, representing himself, testified in support of HB 4440. Robin Schneider, representing the Michigan Cannabis Industry Association, testified with a neutral position on HB 4440. Questions and discussion followed. At 9:24 AM, the Chair laid the committee at ease. At 9:26 AM, the Chair called the committee back to order. Representative Lilly offered the following amendments to HB 4440: 1. Amend page 2, line 26, after "AFTER" by striking out the balance of the line through "SUBDIVISION," on line 27 and inserting "JUNE 1, 2019,". 2. Amend page 8, following line 7, by inserting: "(16) THE DEPARTMENT SHALL, BEFORE JUNE 1, 2019, MAKE EVERY EFFORT TO PROCESS, OR ISSUE A FINAL DETERMINATION FOR AN APPEAL REGARDING, AN APPLICATION SUBMITTED ON OR BEFORE THE EFFECTIVE DATE OF THE AMENDATORY ACT THAT ADDED THIS SUBSECTION.". Questions and discussion followed. Representative Lilly moved to adopt the amendments to HB 4440. The motion prevailed 5-0-0: FAVORABLE ROLL CALL Yeas: Reps. Sheppard, Cole, Lilly, Greig, Rabhi. Nays: None. Pass: None. The following people submitted a card in support of HB 4440, but did not wish to speak: State Licensee - Redbud Roots. State Licensee – Pharmaco. State Licensee – Motas. Wes Lutz, representing Choice Labs. Rob Elhericky, representing Great Lakes Canabis Chamber of Commerce. Ben Joffee, representing CannArbor. State Licensee - Alternative Gardens. The following people submitted a card in opposition of HB 4440, but did not wish to speak: Frank Waters, representing the Michigan Department of Licensing and Regulatory Affairs. Kelli Hykes, representing Weedmaps. Representative Lilly moved to report House Bill No. 4440 as amended, as substitute (H-1). The vote was as follows: Yeas: Reps. Sheppard, Cole, Lilly, Greig, Rabhi. Nays: None. Pass: None. There being no further business before the committee, Rep. Jason Sheppard adjourned the meeting at 9:28 AM.
