STEVE MARINO CHAIR COMMITTEE MEETING MINUTES Thursday, October 24, 2019 9:00 a.m. Room 327, House Office Building The House Standing Committee on Commerce and Tourism was called to order by the Chair. The Chair requested attendance be called: Present: Reps. Marino, Wendzel, Reilly, Meerman, Schroeder, Wakeman, Cambensy, Camilleri, Hope, Manoogian, Robinson. Absent/Excused: None. Representative Schroeder moved to adopt the meeting minutes from October 17, 2019. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5127 and HB 5128 before the committee: HB 5127 (Rep. Kahle) A bill to amend 1937 PA 94, entitled “Use tax act,” by amending section 4cc (MCL 205.94cc), as added by 2015 PA 252. HB 5128 (Rep. Warren) A bill to amend 1933 PA 167, entitled “General sales tax act,” by amending section 4ee (MCL 205.54ee), as added by 2015 PA 251. Representative Bronna Kahle and Representative Rebekah Warren, the bill sponsors, explained HB 5127 and HB 5128. Questions and discussion followed. Barbara Comstock, Advisor to NetChoice and former Congresswoman, Virginia Legislator, and Steve DelBianco, President of NetChoice and former Director of Virginia Economic Development Partnership, testified in support of HB 5127 and HB 5128. Questions and discussion followed. A copy of their PowerPoint and written testimony is attached. The following individuals submitted a testimony card in opposition to HB 5127 and HB 5128, and did not wish to speak: Rachel Richards, Director of Legislative Affairs for the Michigan Department of Treasury; Kathleen Merry, Executive Director, Legislative Affairs for Wayne RESA; David Zuhle, Ph.D., Governmental and Legislative Liaison for Middle Cities Education Association; David Randels, Director of Government Relations for Oakland Schools; Peter Spadafore, Associate Executive Director for Advocacy and Communications for the Michigan Association of Superintendents and Administrators; and Bob KeFgen, Director of Government Relations for the Michigan Association of Secondary School Principals. David Wortham, Vice President of Policy for the Michigan Bankers Association, submitted a card with a neutral position on HB 4835 and HB 4836, but did not wish to speak. The Chair laid SB 319 and HB 4091 before the committee: SB 319 (Sen. Moss) A bill to amend 1992 PA 147, entitled “Neighborhood enterprise zone act.” by amending sections 2, 7, and 10 (MCL 207.772, 207.777, and 207.780), section 2 as amended by 2010 PA 9, section 7 as amended by 2008 PA 284, and section 10 as amended by 2005 PA 339, and by adding section 2a. HB 4091 (Rep. LaFave) A bill to amend 1992 PA 147, entitled “Neighborhood enterprise zone act,” by amending sections 2 and 8 (MCL 207.772 and 207.778), section 2 as amended by 2010 PA 9 and section 8 as amended by 2005 PA 339. Jennifer Smith, Director of Government Relations for the Michigan Association of School Boards, submitted a testimony card in opposition to HB 4091, but did not wish to speak. Brad Ward, Vice President of Public Policy and Legal Affairs for the Michigan Realtors, submitted a testimony card in support of HB 4091, but did not wish to speak. Representative Wakeman moved to adopt substitute (H-1) to SB 319. The motion prevailed 11-0- 0: FAVORABLE ROLL CALL Yeas: Reps. Farrington) A bill to amend 1984 PA 270, entitled “Michigan strategic fund act,"(MCL 125.2001 to 125.2094) by adding section 15. The following individuals submitted a testimony card in opposition to HB 4835 and HB 4836, and did not wish to speak: Andy Johnston, Vice President of Government and Corporate Affairs for the Grand Rapids Chamber of Commerce, and Charles S. Owens, Michigan State Director for the National Federation of Independent Business. Representative Wakeman moved to adopt substitute (H-2) to HB 4835.
