- HOUSE OF REPRESENTATIVES COMMITTEE ON COMMERCE AND TOURISM REP. STEVE MARINO CHAIR COMMITTEE MEETING MINUTES Thursday, November 7, 2019 9:00 a.m. Room 327, House Office Building The House Standing Committee on Commerce and Tourism was called to order by the Chair. At 9:03 a.m., the Chair laid the committee at ease. At 9:06 a.m., the Chair called the committee back to order. The Chair requested attendance be called: Present: Reps. Marino, Wendzel, Reilly, Meerman, Schroeder, Wakeman, Cambensy, Camilleri, Hope, Manoogian, Robinson. Absent/Excused: None. Representative Schroeder moved to adopt the meeting minutes from October 31, 2019. There being no objection, the motion prevailed by unanimous consent. The Chair laid HB 5150 and HB 5151 before the committee: HB 5150 (Rep. Hoadley) A bill to create and operate a centralized reasonable accommodations program; to prescribe the duties and powers of certain state agencies and certain state officials; and to provide for the distribution of money. HB 5151 (Rep. Marino) A bill to amend 1969 PA 317, entitled “Worker’s disability compensation act of 1969,"(MCL 418.101 to 418.941) by adding section 539. Representative Jon Hoadley, the bill sponsor, explained HB 5050 and HB 5051, and submitted written testimony. Questions followed. Michelle Roberts, Executive Director for Michigan Protection and Advocacy Service, Incorporated, Miranda Grunwell, Community Education Coordinator, and Paul Ecklund, ADA Specialist and Systems advocate for Disability Network Southwest Michigan, testified in support of HB 5150 and HB 5151. Questions followed. Ms. Roberts written testimony is attached. Lauren Bake, Executive Director for Disability Network Oakland and Macomb, testified in support of HB 5150 and HB 5151. Bonnie Gonzalez, Chairperson of the Michigan Developmental Disabilities Council, submitted a card and written testimony in support of HB 5150 and HB 5151, but did not wish to speak. Andrew Beardslee, representing the Department of Labor and Economic Opportunity, submitted a card with a neutral position on HB 5150 and HB 5151, but did not wish to speak. At 9:40 a.m., the Chair laid the committee at ease. At 9:41 a.m., the Chair called the committee back to order. The Chair explained it was his intention to refer HB 4303 to the House Standing Committee on Ways and Means, when the Majority Floor Leader gives committees leave to meet. At 9:42 a.m., the Chair laid the committee at ease. At 11:00 a.m., the Chair called the committee back to order. At 11:01 a.m., the Chair laid the committee at ease. At 11:02 a.m., the Chair called the committee back to order. The Chair laid HB 5187 and HB 5188 before the committee: HB 5187 (Rep. Warren) A bill to amend 1933 PA 167, entitled “General sales tax act," by amending section 25 (MCL 205.75), as amended by 2015 PA 262. HB 5188 (Rep. Huizenga) A bill to amend 1937 PA 94, entitled “Use tax act,” by amending section 21 (MCL 205.111), as amended by 2015 PA 263. Representative Mark Huizenga, the bill sponsor, explained HB 5187 and HB 5188. Questions followed. Jennifer Smith, Director of Government Relations for Michigan Association of School Boards, submitted a testimony card in support of HB 5187 and HB 5188, . The Chair laid HB 4303 before the committee: HB 4303 (Rep. Hoitenga) A bill to provide for the official time followed in this state; and to provide for the elimination of daylight savings time in this state. David Guenthner submitted a testimony card in support of HB 4303. but did not wish to speak. Douglas McDougal submitted written testimony in support of HB 4303. Representative Meerman moved to refer House Bill No. 4303 to the committee on Ways and Means, with recommendation as substitute (H-2). At 11:08 a.m. Chair laid the committee at ease. At 11:10 a.m., with all members present, the Chair called the committee back to order. The motion prevailed 6-4-1: FAVORABLE ROLL CALL Yeas: Reps. Marino, Reilly, Meerman, Schroeder, Wakeman, Robinson. Nays: Reps. Cambensy, Camilleri, Hope, Manoogian. Pass: Rep. Wendzel. The Chair laid HB 5127 and HB 5128 before the committee: HB 5127 (Rep. Kahle) A bill to amend 1937 PA 94, entitled “Use tax act,” by amending section 4cc (MCL 205.94cc), as added by 2015 PA 252. HB 5128 (Rep. Warren) A bill to amend 1933 PA 167, entitled “General sales tax act,” by amending section 4ee (MCL 205.54ee), as added by 2015 PA 251. The following individuals submitted a card in opposition to HB 5127 (H-3), but did not wish to speak: Brandon Betz, representing the Michigan League for Public Policy; Andy Newmann, representing the Michigan Education Association; and James M. Hohman, representing the Mackinac Center for Public Policy. At 11:16 a.m., the Chair laid the committee at ease. There being no further business before the committee, Rep.
